Note: A copy of these terms and conditions will be emailed upon booking confirmation. Ongoing General Cleaning Thank you for choosing Halwest Property Services to do your cleaning service. The price you have been quoted is based on an ongoing general cleaning service. Any properties that are very dirty will incur an additional charge. This will be discussed with the customer on the day when the cleaner views the property. Please note: Before and after photos of the property may be taken for comparison and quality control purposes. Please note: For health and safety reasons, we recommend that the customer wait to enter the property until the cleaning is complete and the floors have fully dried. 1. THE APPOINTMENT AND PROPERTY ACCESS The customer by this agreement engages Halwest Property Services to perform the ongoing general cleaning service. Halwest Property Services has agreed to perform the services for the customer for the price as per electronic communication. Halwest Property Services represents and warrants to the customer that Halwest Property Services, its employees, sub-contractors, and associates have all the necessary skills, knowledge, experience, and expertise to perform the services and will perform the services to a good and proper standard. Halwest Property Services holds all necessary licenses and permits required in order to allow the cleaners to perform the ongoing general cleaning service. The customer agrees to allow access to all areas of the property to Halwest Property Services unless otherwise specified in writing. The customer agrees to provide access to the property including its utilities (power, hot and cold water and bins) during the cleaning service including any return visits. The customer may meet the cleaners at the property at the agreed time to provide property access or alternatively the customer may choose to leave the key at the property so the cleaners can gain access (e.g. in the meter box or letterbox) or at another location. The customer should notify Halwest Property Services if a key will be left out. The cleaners will leave the key in the same location on completion. Should the property key be required to be collected from another location, Halwest Property Services reserves the right to charge a key collection and/or return fee. It is the customers responsibility to provide parking access to the cleaners. Should parking be required to be paid for, the cost of the parking during the cleaning service will be added to the customers invoice. If the property is deemed a health or safety risk by the cleaner on the day when the cleaner views the property, Halwest Property Services reserves the right to discontinue or cancel the service. Halwest Property Services reserves the right to reschedule or cancel the appointment in the event of an unforeseen circumstance including but not limited to schedule delay, staff shortage or illness and government enforced restrictions. Halwest Property Services will notify the customer as promptly as possible in such an event. In the event that the appointment needs to be cancelled by the customer, the customer agrees to provide Halwest Property Services a written notice at least 48-hours prior to the scheduled appointment. In the event that the appointment is cancelled by the customer less than 48-hours from the scheduled appointment, the customer agrees to pay Halwest Property Services a cancelation fee of $135.00. 2. THE PRICE, PAYMENT AND VARIATION The customer has agreed to pay Halwest Property Services on the day of service the fees as set out in the electronic communication. In respect of the Halwest Property Services fees, the customer will pay for the service using the card details provided upon booking. In the event that payment is not received on the day of service, the customer agrees to pay Halwest Property Services a 10.00% per annum late fee on the invoiced amount. In some circumstances, Halwest Property Services may at its absolute discretion request for payment to be processed prior or during the service. Halwest Property Services will issue a paid tax invoice within 24 hours of completing the service via email, setting out the services performed and the date they were performed. 3. BREACH BY THE CUSTOMER If the customer decides to cease using Halwest Property Services, the customer has agreed to not communicate with, engage or employ the cleaner for a period of twelve (12) months from the date of service cancelation. If the customer fails to pay the whole or any part of the fees without reasonable and lawful excuse, Halwest Property Services may at it’s absolute discretion: (a) Suspend the performance of the services until the fees then outstanding are paid and/or: (b) Serve a written notice to the customer requiring the outstanding amount of the fees to be paid within seven days and if not so paid by written notice terminate the agreement and/or: (c) Submit the outstanding debt to a court and/or a debt collection agency with all additional fees and charges payable by the customer. 4. INDEMNITY The customer indemnifies Halwest Property Services against: . i) Loss or damage to property (including cleaning works). . ii) Claims in respect to personal injury or loss of any kind, arising out of or in connection to or as a consequence of the contractor and or sub-contractor. . iii) Any liability that Halwest Property Services may suffer or incur under a statutory warranty in connection with the cleaning service. 5. TERMINATION The customer may at any time cancel the cleaning service by providing a 7 day written notice to Halwest Property Services. 6. NOTIFICATIONS The customer has agreed to allow Halwest Property Services to send emails and/or text messages that may be regarding the customers booking confirmation, booking updates and promotional material. The customer may unsubscribe from the notifications at any time by notifying Halwest Property Services.
